Divorce
You may be hoping that the current troubles will pass or you may have decided that your marriage is beyond repair. In either case, it is sensible to take early advice. We can put you in touch with services to help you work towards a reconciliation or if it is too late for that, put in place a structure to guide you through to a new life whilst reducing the uncertainty and acrimony which can flow from divorce. The same applies to the same-sex couples who since December 2005, have registered as Civil Partners.
Financial Settlements
We deal with the broadest range of clients and financial situations from straightforward agreements to the most complex negotiations involving overseas properties, companies, trusts, pensions and international issues. We adopt a down to earth and practical approach in order to help clients and their spouses reach agreement on a sensible financial settlement which also preserves goodwill for their sakes and those of any children. If firm action is necessary, however, (for example to trace hidden assets or to freeze them until an overall deal is reached) we help you obtain the necessary protection from the Courts.
Unmarried couples
Unmarried couples are often far from sure of their rights. What does 'common-law spouse' mean? What happens about financial support and the children? There are complex rules governing property rights for unmarried couples living together which are very different from those in relation to married couples. We provide the specialist advice needed to acheive a solution without spending the assets in legal fees.
Children
We deal with all disputes relating to children ranging from residence (custody) to contact (access), to specific parenting issues such as schooling or medical treatment. We also act in applications to take a child to live abroad permanently.
Enforcement or variation of orders made in family proceedings
Court orders made in the past can end up being ignored or needing updating over time. We deal with applications to the court to enforce orders or vary them whilst advising on the chances of success and current relevant circumstances which might affect such an application.
